Terms of Service

PersonalityAI and Digital Twin AI are products of Engage AI Ventures LLC. PersonalityAI is the studio side, where artists record and license their digital twins. Digital Twin AI is the marketplace side, where brands and agencies lease those twins for licensed use. Both sites run on the same infrastructure; the brand chrome differs.

We support two account types. Creators (artists) record a take and license their digital twin under their own terms. Enterprises lease members' likenesses for specific, scoped uses defined in a written contract. You agree to the terms applicable to your account type; if you operate as both, you agree to both sets.

Every digital twin on this platform was created from an affirmative recorded take by the artist whose likeness it represents. Artists may revoke any lease at any time with a minimum 90-day notice; the platform will honor the revocation window and notify the leasing enterprise. Active rendered outputs created during a valid lease window remain valid through the end of that window.

You will not use the platform, any rendered output, or any leased likeness to: (a) impersonate the artist outside the bounds of the licensed use case; (b) generate content that violates the artist's stated boundaries; (c) generate political endorsements, election-related content, or campaign materials, except where the artist has explicitly licensed for those uses; (d) generate sexually explicit content, harassment, or unlawful content; (e) circumvent the C2PA-compatible provenance markers attached to renders. We reserve the right to suspend accounts that violate these limits, with notice where practical.

Subscription plans (Silver, Gold, Diamond) and per-twin lease fees are billed in advance through Stripe in the currency displayed at checkout. Coupon codes may waive specific charges as noted at the time of redemption. Cancellation stops the next billing cycle; we do not pro-rate or refund partial-month subscriptions unless required by law.

Artists retain all rights in their likeness and underlying recordings. Enterprises receive a limited, non-exclusive, revocable license to use rendered outputs within the scope and timeline defined in their contract. PersonalityAI retains all rights in the platform software, model weights derived from training, and aggregated analytics. Nothing in these terms transfers ownership of an artist's likeness to an enterprise or to us.

How we collect, use, retain, and share your data is described in our Privacy Policy. By using the platform you agree to those practices.

All twin renders are clearly identifiable as AI-generated media and carry provenance metadata. We comply with California AB 2602 / SB 942 disclosure obligations and other applicable AI-content laws as enumerated in our AI Disclosure.

The platform is provided "as is" without warranties of any kind. We do not warrant uninterrupted availability, error-free operation, or that any specific commercial outcome will result from leasing a twin. To the maximum extent permitted by law, we disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Our aggregate liability under these terms is limited to the greater of (a) the amount you paid us in the twelve months prior to the event giving rise to the claim, or (b) USD 100. We are not liable for indirect, incidental, consequential, punitive, or special damages.

Either party may terminate the account at any time. We may terminate or suspend accounts for material breach of these terms with notice where practical. Termination does not affect already-rendered outputs created during a valid lease window, which continue to operate under their original license terms until their natural expiry.

These terms are governed by the laws of the State of California, without regard to conflict-of-laws principles. Any dispute will be resolved in the state or federal courts of San Francisco County, California, except where applicable law requires otherwise.

We may update these terms from time to time. Material changes will be communicated by email and posted with a new "Last updated" date at the top of this page. Continued use of the platform after a change indicates acceptance of the updated terms.
